Terms of Service

These terms govern your use of TIER, a digital strength and physique ranking platform operated by Jefrey Bergl (referred to here as "we", "us", or "TIER"). By purchasing a Founder membership or using tierfounders.com you agree to these terms.

TIER is a digital ranking platform for serious lifters. The platform analyzes user-submitted physique photos and self-reported strength data to assign a tier (Bronze through Apex), normalized to weight class and training age. The platform is in pre-launch development.

Beta access opens to Founder members in Q3 2026. The public launch is Q4 2026.

A Founder membership is a one-time $29 USD purchase that grants:

• Lifetime access to TIER's ranking features
• A founder badge on your rank card and leaderboard entries
• A direct say in v1 feature priorities
• First-cohort beta access in Q3 2026
• A full refund if we do not launch the platform by December 31, 2026 (see Section 5)

After the first 100 Founder memberships are sold, non-founder access opens at $150 per year. Founders pay only the one-time fee — never any recurring charge.

You must be 18 or older to purchase a Founder membership. By purchasing you confirm you meet this requirement.

Payment is processed by Stripe. By purchasing, you authorize Stripe to charge your payment method the full purchase price. Stripe's terms apply to the payment transaction.

If TIER has not launched by December 31, 2026, you may request a full refund of your Founder purchase by emailing hi@tierfounders.com. We will process the refund through Stripe within 14 days of receiving your request.

Outside that scenario, refunds are at our discretion. Founder memberships are otherwise sold as final purchases.

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use TIER for your own non-commercial use, subject to these terms. You may not:

• Sell, rent, or transfer your Founder membership
• Reverse-engineer, decompile, or otherwise extract the platform's source
• Use TIER to harass, threaten, or discriminate against any other user
• Use automated means to scrape data from leaderboards
• Submit content (photos or text) you do not have the right to submit, or that depicts another person without their consent

We may suspend or terminate your access if you breach these terms.

When you submit physique photos, strength data, or other content to TIER, you grant us a worldwide, royalty-free license to use that content solely to operate the platform — including to compute your tier, display your rank card, and aggregate anonymized data for cohort statistics. You retain all rights in your content. We do not sell user content.

You can request deletion of your content by emailing hi@tierfounders.com.

The TIER name, brand, tier system, ranking methodology, and platform code are owned by us. These terms do not grant you any rights to our intellectual property other than the access license in Section 6.

TIER is provided "as is" and "as available". We make reasonable efforts to keep the platform accurate and available, but tier estimates are inherently approximate. We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total liability to you for any claim arising from these terms or your use of TIER is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages.

This limitation does not apply to liability for death or personal injury caused by our negligence, or to anything else that cannot lawfully be excluded.

You agree to indemnify and hold us harmless against any claim arising from your breach of these terms or your misuse of TIER.

These terms are governed by the laws of North Coarlina, United States, without regard to its conflict-of-laws rules. Any dispute arising from these terms will be resolved exclusively in the state or federal courts located in Guilford County, North Carolina.

If you are an EU/UK consumer, you may also have the right to bring proceedings in your country of residence under local consumer protection laws.

We may update these terms. Material changes will be notified to Founder members by email at least 14 days before they take effect. Continued use of TIER after the effective date constitutes acceptance.
