Privacy Policy

TIER is a digital strength and physique ranking platform operated by Jefrey Bergl (referred to here as "we", "us", or "TIER"). Our website is tierfounders.com. The platform is in pre-launch — the application itself launches in Q3 2026 to Founders and Q4 2026 to the general public. You can reach us at hi@tierfounders.com for any privacy questions or to exercise your rights.

When you purchase a Founder membership we collect:

• Your full name — to personalize your founder card and profile
• Your email address — for your receipt, confirmation, and beta-launch notification
• Your stated lifts (bench, squat, deadlift, bodyweight, frequency, training years) and chosen unit — used to calibrate your initial tier estimate when the platform launches
• The apps you currently use and your stated priorities for what TIER should build — used to inform product direction
• Optional invite contacts you provide (Instagram or TikTok handles, or phone numbers) — used only to send the invite you authorize and to gauge founder network density
• Payment information — handled by Stripe (see Section 4)

When you visit tierfounders.com we also collect, via PostHog analytics, the pages you view, links you click, scroll depth, session duration, device and browser, approximate city/country location derived from your IP, and an anonymous cookie ID so we can stitch your visits together.

We do not collect financial information beyond what Stripe handles, health information, biometric data, or any sensitive categories under GDPR Article 9.

For EU/UK residents we process personal data under these lawful bases:

• Contract performance — for your Founder purchase and providing the eventual platform
• Legitimate interest — for product analytics, fraud prevention, and transactional email about your purchase
• Consent — for any marketing email beyond the beta-launch notification, and for non-essential cookies in jurisdictions that require it

You can withdraw consent at any time. We will continue to process data we need under contract or legal obligation.

We share data only with the service providers we depend on to operate TIER. We do not sell your data and we do not share it with any party other than the processors below.

• Stripe (Stripe Payments Europe Ltd., Ireland) — processes your payment. stripe.com/privacy
• Supabase (Supabase Inc., USA) — stores your founder record and survey responses. supabase.com/privacy
• Vercel (Vercel Inc., USA) — hosts the website and serverless functions. vercel.com/legal/privacy-policy
• PostHog (PostHog Inc., USA) — product analytics. posthog.com/privacy
• Twilio (Twilio Inc., USA) — sends SMS invites you have asked us to send (only when configured). twilio.com/legal/privacy
• Meta (Meta Platforms Inc., USA) — receives conversion events via the Conversions API for ad measurement, only when ad campaigns are active. facebook.com/privacy/policy
• TikTok (TikTok Pte. Ltd., Singapore) — receives conversion events via the Events API for ad measurement, only when ad campaigns are active. tiktok.com/legal/privacy-policy

Some of our processors operate from the United States. Where personal data of EU/UK residents is transferred to the US, we rely on the European Commission's adequacy decision for the EU-US Data Privacy Framework or on each processor's standard contractual clauses (SCCs).

• Payment records — 7 years (legal/tax obligation)
• Founder records and survey responses — for as long as you are a member, then 12 months after a deletion request
• Analytics data — 24 months from last activity
• SMS invite logs — 12 months
• Email logs — 24 months

You can ask us to delete your data at any time — see Your Rights below.

If you are an EU/UK/CCPA resident (and many other jurisdictions extend similar rights), you have the right to:

• Access — get a copy of the personal data we hold about you
• Rectification — correct anything that's wrong
• Deletion — ask us to delete your data, subject to the legal retention requirements above
• Portability — receive your data in a structured, machine-readable format
• Objection / restriction — restrict how we process certain data
• Withdrawal of consent — for any processing based on consent
• Complaint — lodge a complaint with your local data protection authority

We use:

• Functional cookies (Stripe, session) — necessary for the site to work
• Analytics cookies (PostHog) — to understand how the site is used

We do not use third-party advertising cookies on this site. When we run ad campaigns, conversion measurement happens server-side via Meta CAPI and TikTok Events API — no third-party ad cookies are dropped here.

TIER is not directed at children under 16. We do not knowingly collect data from anyone under 16. If you believe we have data from a child under 16, contact us and we will delete it.

Data is encrypted in transit (HTTPS) and at rest (provider-managed encryption). We restrict internal access to data on a need-to-know basis. We will notify affected users and the relevant authority within 72 hours of becoming aware of any qualifying personal data breach.

We may update this policy. Material changes will be notified to Founder members by email. The latest version is always at tierfounders.com/privacy.
